TERMS OF SERVICE

Agreement: This agreement is between Deep Electric Inc. (contractor) and you (customer, an agent of the customer, or property owner). By signing this document with your signature, you agree to accept, bearing any and all responsibility of contract between you and Deep Electric Inc. Deep Electric is hereby retained, employed, and authorized by you to perform services at the above-referenced address of property/s. You will be responsible for all out of pocket cost our firm/company incurs from your property.  Such cost includes any and all costs relating to your requested services including labor, materials, transactions, documents, Notary, Governmental services, and any out-of-pocket costs during and after the project are completed on your property. Customer understands and agrees to contract with Deep Electric Inc, is aware that he/she is signing to a contract, agreeing to a binding contract including front and back of this document and will adhere to and abide by all terms and conditions.  All permits only include one hour of inspection service during the inspection time frame with the county inspector. On such condition/s additional charges will apply in excess of one hour.  All project equipment specs, voltage, amperage, and wattage must be provided by the customer before any wiring or servicing, and/or installation performed on the property. (If none is provided before installation or service, customer bear full responsibility for all costs for repair, alterations, redo or do overwork for the project.  If a customer hires any handyman or any personnel for any service/s or repair/s on his/her property for any reason of which handyman/person/s interfere or tamper with (our) Deep Electric Service/s repair/s or installation/s, the customer will be responsible for any and all cost burden associated with interference or tampering of such service/s provided by Deep Electric.

  1. Services and Repairs: Customer must provide a 50% deposit before work begins. The remaining balance is to be paid upon completion of the final job, Depending on the size of your project. Please be advised that due to unknown repair/s customer agree/s that estimated fee/s or costs are based on visible work only and not on unknown work or, work behind wall/s, partitions, or behind covered enclosure/s. Customers also agree to take responsibility for drywall /paint repairs etc.; On all services and installations. 
  2. Cancellation Policy: Once the contract is accepted; no cancellation is allowed for any reason. If cancellation occurs by you the customer for any reason, a 20% fee will be charged from the total contract amount, plus the incurred cost of previous work performed, at the maximum allowed by Law per day, per month or, 18% annum whichever is greater. Contractor (Deep Electric Inc.) will remain the owner of all materials and or equipment until paid in full with no legal recourse or obligation/s to Deep Electric Inc.
  3. Obligations: I (the customer) understand that I am responsible to pay and make all payment cost of all products and services provided by Deep Electric Inc. Contract is with the obligation by me the customer to pay, but renders no exception/s to me the customer once the project is in process and or once I the customer authorizes the work on my property. Customer also agrees to pay Deep Electric Inc. for any and all work done whatsoever including troubleshooting and or diagnostic time spent finding fault or causes of failure and or malfunction of Device, equipment, non-working electrical system/s with direct or indirect causes. The customer gives rights to Deep Electric Inc. with consent by verbal audio recordings as authorization.  All changes, made by the customer will be additional charges incurred and will be added to the final bill. Invoice statements are due and payable upon receipt. Any amounts unpaid Past due balances after (30) days shall bear interest at the maximum allowed by Law per day, per month, or 18% annum, whichever is greater. Contractor (Deep Electric Inc.) will remain the owner of all material/s or equipment/s until paid in full with no legal recourse or obligation/s to Deep Electric Inc.
  4. Service Schedule: If payment is not made on schedule, then Deep Electric will reserve the right to withdraw from the project and stop all work until payment is made and up to date. Once all payments are up to date work will resume as normal. If no payment is made by the customer for the final bill, then the customer gives full rights to Deep Electric Inc to pursue final payment by all or any means of collection/s and or, to remove all and any work-related material from property/premises at customer or property owner’s expense, at any given time, even if customer sell or transfer of property legally to anyone. 
  5. Charges: You the customer will be charged for our services at the time, during, and after service is rendered. If service is for a project with a prolonged period of time, you will be billed on periodic terms of 10 days, 15 days, or up to (30) days increments and until completion of the project, but cash on delivery (COD) will prevail. Payments are to be made in US funds only and due upon completion of a job or a maximum of 30 days from the date of service. In the event that there is a dispute regarding our work and collection agency or litigation is necessary to collect any or all monies due us, we shall be entitled to any and all collection cost including reasonable Attorney’s fee/s and cost/s, including but not limited to Pre-court cost/s for the efforts of any collection/s agency or, our Attorney retained by us in such action(s) and or administrative proceedings. All liquid and or damages, charges, costs, fees caused by or on behalf of you the customer, and your property, you the customer agree to be responsible for such costs and to pay all costs associated with any charge including any and all collectors or Attorney Fees. The customer is responsible for any and all costs relating to permitting and inspection fees, including inspection schedule, process, and appointments.  You are certifying that all of the statements provided by you (whether verbally or written) communicated to us (Deep Electric Inc.) are true and correct. If any information given by you deemed suspicious, you shall be held liable and be subject to prosecutions or be referred to Governing authorities. Anything else express or implied elsewhere which is contrary to these conditions shall be null and void. Any charges, costs, or fees provided to you the customer in writing shall be enforced and be bound/binding to you and your property. In the event of any legal action and or suit deemed necessary, the venue for such proceeding will be held in Orange County, Florida.
  6. Check Acceptance Policy: In the event that your check or another form of payment is returned for insufficient or held funds, we will debit your checking account or credit card on file electronically for the face amount of the check plus the fee listed below. This policy allows us to resolve the problem without reporting you to a credit bureau and harming your credit rating. The transaction will appear on your bank statement and no one will have to contact you for payment if paid by credit card or another payment form. The fee amount of $45.00 for insufficient funds on checks returned and credit cards if funds are unavailable. Bid proposals or estimates are guaranteed for 30 days. All materials and labor are guaranteed on completed work for one (1) year or as mentioned elsewhere in this contract, based on service or repairs performed and or if any warranty is rendered.
  • All applicable taxes are included in our submission
  • Deep Electric shall not be held liable for errors or omissions in designs by others, nor inadequacies or materials and equipment specified by others.
  • Equipment and materials supplied by (Deep Electric Inc.) are warranted only to the extent that the same are warranted by the manufacturer or as specified elsewhere in this contract. No warranty on material provided by the customer, no exception.
  • Deep Electric Inc. shall not be liable for indirect loss or damage.
  • Unless included in this contract, all special bonding or special insurance requirements other than provided by us will be of the additional cost. (Deep Electric Inc.) is licensed, Insured, and bonded.
  • If a formal contract is required, its conditions must not deviate from this contract without the contractor’s (Deep Electric Inc.) permission.
  • Anything (verbal or written), express or implied elsewhere, which is contrary to these conditions shall be null and void. Any changes, costs, charges, or fees provided to customers in writing shall be enforced.
  • Any change requested by you (customer) to this contract for any additional work that needs to be performed which is not included in this contract will increase your cost and be of additional charges applied to the customer’s bill.
    1. Warranty:  All material/s is guaranteed to be as specified. All work to be completed in a workmanship-like manner according to standard practices. Any alteration or deviation from the plan specifications received from the customer involving extra cost will be executed only upon written orders and will become over and above the proposal/contract amount. All agreements contingent upon strikes, accidents, or delays are beyond our control. Customer/owner or agent of the property owner shall carry fire, tornado, and other necessary insurance coverage. This warranty shall not apply to any work performed or has been tampered with, or any work that has been done by others but not authorized by Deep Electric Inc. Any work performed by others will void our warranty to you, and such work is prohibited. Our workers are covered by Workers Compensation Insurance. 
    2. Conflicts: Customer and employee (s) Of Deep Electric Inc. are aware that the customer agrees and waives any rights to accept work from Deep Electric Inc. employee (s) while employed for any reason, not less than one full year. If any side work employment occurs customer agrees to Pay Deep Electric Inc. a minimum of 50% of all work, repair, or installation costs performed by the employee plus any additional charge needed to satisfy the National Electrical Code. Customer and Employee will also be referred to as legal agencies and are subject to prosecution.
    3. In case of emergency service repairs, the owner/ customer agrees to hold harmless (Deep Electric Inc) for any damage resulting from any attempts to repairs or install to structure by use of material/s, equipment/s or other means to secure or improve the structure of the property.
    4.  Please indicate your acceptance of our terms of services and agreement regarding services rendered herein to you by signing the original of this service agreement contract in the appropriate space provided.

  • Insurance Related services

 

For insurance repair services, as a security for said contractors fee, the customer, property owner/s, or authorized agent hereby authorize that the insurance carrier/company to include (Deep Electric Inc.) on any and all check or payment method or note issued for said service/s.

  • Insured hereby agrees and authorizes the Insurance Carrier/company to release all repair, or Install service payments Directly to Deep Electric Inc. The deductible portion if applicable of ___________is to be paid to Deep Electric Inc. at the time of service.  
  • Long Term service agreement: Customer agrees to use only Deep Electric Inc for all electrical and Lighting services for a minimum set time of ________________ (       ) year/s. At the set given price for service to be done by __ Monthly __ Weekly __ Daily. for $________________
